This Terms of Service Agreement (“Agreement”) is entered into between Grow Trees (“Company”) and the individual (“Buyer”) who wishes to buy a teak sapling program offered by the Company. By participating in the teak sapling program, the buyer agrees to be bound by the terms and conditions set forth in this Agreement.

Teak Sapling Program:

(a) The Buyer agrees to make one-time payment of US$200 or US$375 or US$500 to the Company for single. double. triple sapling(s) or more than three respectively for the duration of twelve years envisaged for the full growth of a teak tree.

(b) In exchange for the payment, the Company will undertake the following:

(i) Plant teak sapling(s) consistent with the plans, i.e., Solo, Duo or Trio, in its forest/farm on behalf of the buyer.

(ii) Irrigate and maintain the teak sapling(s) for its entire growth period.

Rights and Obligations:

(i) The Buyer will be entitled to receive updates on the progress of their teak sapling(s) periodically.

(ii) The Byer will have the option to visit the Company’s Forest/farm upon prior arrangement to witness the growth of their teak tree.

(b) Buyer’s Obligations:

(i) The Buyer agrees to provide accurate and complete information required for registration and payment.

(ii) The Buyer acknowledges that the growth of the teak tree(s) depends on various factors, including climate and environmental conditions, and that the Company will make best efforts to ensure successful growth.

Transferability

The Buyer acknowledges that the purchase in the teak sapling program is non-transferable and cannot be assigned to any other individual or entity.

Risks

The Buyer acknowledges that the growth and success of the teak trees are subject to various risks, including but not limited to natural disasters, fire, diseases, pests, or any factor classified as force majeure. The Company will undertake reasonable measures to mitigate these risks but does not guarantee the ultimate success of every teak tree.

Termination

The Buyer may terminate his/her participation in the teak sapling program at any time by providing written notice to the Company. In the event of termination, the Company will be obligated to refund up to maximum fifty percent of the payment already made by the Buyer.

Limitation of Liability

The Company will not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of the Buyer’s participation in the teak sapling program.

Governing Law and Jurisdiction

This Agreement will be governed by and construed in accordance with the laws of the jurisdiction where the Company is located. Any disputes arising out of or in connection with this Agreement will be subject to the exclusive jurisdiction of the courts in the aforementioned jurisdiction.
